Direct Answer / Legal Takeaway:

Executing a standardized power of attorney format or general power of attorney format india creates a formal legal instrument governed by the Powers of Attorney Act, 1882 and the Indian Contract Act, 1872 (Section 182). It authorizes a designated person (known as the Attorney, Agent, or Donee) to act on behalf of the person creating it (the Principal or Donor). Whether drafting a power of attorney format for property or a power of attorney format for authorised signatory, following the Supreme Court’s landmark ruling in Suraj Lamp & Industries vs State of Haryana (2012) ensures clear legal authority. 1. What is Power of Attorney in India & Legal Basis

Under Section 1A of the Powers of Attorney Act 1882, a power of attorney format includes any instrument empowering a specified person to act for and in the name of the person executing it.

General Power of Attorney (GPA) Broad management powers over property, banking, tax, and court representation (general power of attorney format) Requires stamp paper + notarization (or registration if managing real estate)

Springing POA Becomes effective only upon the occurrence of a specified future event (e.g. medical emergency) Requires medical certificate or condition proof to activate

3. Registration & Stamp Duty Rules Across Indian States

Stamp duty on a power of attorney format for property is a state subject under Article 48 of the Indian Stamp Act, 1899:

  • General Notarized POA: Executed on ₹100 to ₹500 non-judicial stamp paper for non-property administrative tasks using a general power of attorney format india.
  • Property Sale / Transfer POA: When a POA authorizes an agent to sell immovable property, states like Maharashtra, Delhi, and UP levy stamp duty equivalent to a Conveyance Deed (3% to 7% of market value) unless granted to a close family relative (spouse, child, sibling, parent).

When is Registration Mandatory at the Sub-Registrar Office (SRO)?

Under Section 17 of the Registration Act, 1908, registering a power of attorney format for property at the Sub-Registrar Office is compulsory when:

  1. The POA authorizes the agent to sell, lease, mortgage, or transfer immovable property value exceeding ₹100.
  2. The POA is an irrevocable power given for valuable consideration (Section 202 Indian Contract Act).

4. NRI Power of Attorney: Execution, Embassy Attestation & Adjudication

Non-Resident Indians (NRIs) and Persons of Indian Origin (PIOs) residing outside India can execute a POA to manage Indian assets without traveling to India. The legal process follows a strict two-step protocol:

Step-by-Step NRI POA Process:

  1. Drafting: Draft the POA using a special power of attorney format on plain paper specifying exact details of the Indian property, bank account, or legal suit.
  2. Foreign Execution & Attestation:
    • In Hague Convention Countries (e.g. USA, UK, Australia, Germany): Get the POA notarized by a local foreign notary and apostilled by the competent state authority (e.g., US Department of State / Foreign Office).
    • In Non-Hague Countries (e.g. UAE, Saudi Arabia, Kuwait): Sign the POA before the Consular Officer at the Indian Embassy or High Commission.
  3. Dispatch to India: Send the apostilled/attested POA via registered post or courier to the Attorney (relative/agent) in India.
  4. Adjudication in India (Section 18 Stamp Act): Within 3 months (90 days) of receiving the document in India, the agent must present the original POA before the District Collector / Sub-Registrar for payment of local stamp duty and adjudication stamp.
  5. Registration (if required): If the POA involves property sale, register it at the local Sub-Registrar Office where the property is located.

5. Revocation of Power of Attorney Format & Termination Guidelines

Under Section 201 of the Indian Contract Act 1872, a principal can execute a formal revocation of power of attorney format. A POA is automatically revoked or terminated under the following conditions:

  • Death of Principal or Attorney: A POA automatically lapses upon the death of either party. Acting on a deceased principal's POA is illegal.
  • Insanity or Insolvency: If the principal is declared mentally unsound or insolvent by a court of competent jurisdiction.
  • Express Revocation by Principal: The principal can revoke a revocable POA at any time by executing a revocation of power of attorney format (Deed of Revocation) and issuing public notices.
  • Completion of Purpose: A specific power of attorney format terminates automatically once the specific transaction is completed.

6. Crucial Safeguards & Common Mistakes

Supreme Court Ruling on POA Property Sales (Suraj Lamp Case):

The Supreme Court of India held that "A Power of Attorney is not an instrument of transfer in regard to any right, title or interest in an immovable property." Property buying through GPA sales (without a registered Sale Deed) confers no legal title. Always execute a registered Sale Deed alongside a valid POA.

  • Never Issue Blank POAs: Avoid signing undated or blank POA documents.
  • Define Explicit Expiry Dates: Include a clear validity term (e.g. 1 year) or specific event completion condition.
  • Revocation Notice: When revoking a POA using a revocation of power of attorney format, send a registered notice to the attorney and publish a public notice in local newspapers to prevent unauthorized third-party transactions.
